Introduction

LOVEWINX™ was founded based on the passion for true excellence, exemplary professionalism, revolutionary products, and a desire to provide remarkable opportunities for people to succeed. LOVEWINX™ seeks to empower and educate all people through our unique products, professional demonstrations, and unrivaled business opportunities. LOVEWINX strongly believes that everyone can live a life they have dreamed of and will work collaboratively with their Consultants to ensure their success. As a company, LOVEWINX™ pledges to respect our Consultants and the value they bring to our organization. We know our success as a company is based on the success of our people. We will not bind any Consultant to our company through unfair or illegal practices, including restrictive non-compete clauses. Instead, we promise an open door policy and are committed to creating an environment where Consultants thrive. As an Independent Contractor representing LOVEWINX™, you are asked to respect the guidelines set forth in the following Policies and Procedures. LOVEWINX™ reserves the right to not only amend these Policies and Procedures, but also the LOVEWINX™ Consultant Agreement, compensation plan, product offerings, and product prices. All Consultants will be notified immediately of any modification.

Consultant Guidelines

As a LOVEWINX™ Consultant, your goal is to educate yourself on our products and how to sell them, recruit others to share in this amazing opportunity, and to enhance each Client’s sensual experiences by promoting romance, fun, fantasy, and creativity. Your ultimate achievement is helping both individuals and couples stay happy and fulfilled. LOVEWINX™ will provide you with the resources you need to help you reach your goals. Each LOVEWINX™ Consultant should represent LOVEWINX™ with the highest degree of integrity, professionalism, loyalty, and accuracy. We ask that Consultants do not participate in any activity that is illegal or detrimental to the LOVEWINX™ name, products, opportunity, business, or other LOVEWINX™ Consultants and their business. All LOVEWINX™ Consultants are asked to respect the following LOVEWINX™ Good Standing Requirements. LOVEWINX™ reserves the right to issue a warning to any Consultant in violation of the Good Standing Requirements and to take further action, including termination, if necessary.
  • Please dress in professional business attire for all parties, Corporate-sponsored events, and in all situations while promoting LOVEWINX.
  • Please refrain from the use of inappropriate language and body contact when representing LOVEWINX™.
  • Please conduct business with integrity and honesty.
  • Please display a positive attitude toward Host(s), Clients, Guests, fellow Consultants, and treat everyone with the utmost respect and professionalism.
  • Please do not speak negatively about another Consultant, Host(s), Clients, and Guests.
  • Please do not engage in any deceptive, unlawful, or unethical consumer or sponsoring practice that may be detrimental to LOVEWINX™.
  • Falsifying new Coachee information or orders for the purpose of earning a contest, etc. is a violation of your Good Standing Requirements and may result in termination.
  • Please do not encourage a Host(s), Client, or Recruit to stop doing business with another LOVEWINX™ Consultant.
  • Please fulfill all orders in a timely manner. If a customer is waiting on a backordered item, it is important that you keep the lines of communication open; this will significantly reduce order cancellations and refund requests.
  • Please respect each Client’s privacy by keeping the ordering confidential.
  • Please identify yourself as an Independent Consultant with LOVEWINX™ and not an employee.
  • Please be respectful of the personal, political, and religious opinions of Host(s), fellow Consultants, Clients, Guests, and Corporate Staff.
  • Please do not purchase from or for another Consultant, active or inactive. Anyone in violation will be warned and, if necessary, may be terminated. Product trading is allowed to fulfill a backorder. The LOVEWINX™ corporate office is not responsible for trades.
  • Please direct all concerns regarding Policies and Procedures to your Coach(es) or a LOVEWINX™ Customer Service Representative at cs@lovewinx.com.

Party Guidelines

Parties are for adults only. The goal is to ensure that every Guest at a party feels comfortable and confident with their LOVEWINX™ Consultant and experience. Consultants should strive to treat each Client with respect, courtesy, and keep their orders and ordering history confidential. Products should be presented in a professional and tasteful manner. All product ordering should be done privately so your Clients can feel comfortable and confident in seeking the solutions to their personal situations to live life more passionately. The goal of each LOVEWINX™ Party is to help adults of all ages and lifestyles bring fun, fantasy, romance, and creativity to their relationships. All LOVEWINX™ Consultants are asked to respect the following:
  • Please make sure that all party attendees are adults at least 18 years of age.
  • Infants and/or children should not be present at the Party Location.
  • Please do not charge a fee to individuals for booking or attending a party or event.
  • Please use proper terminology during your presentation.
  • Please refrain from giving medical advice and always refer a client with a medical question to their health care professional.
  • Do not give any inaccurate product information and/or claims.
  • Please make sure there is a private shopping area for confidential ordering.
  • All Consultants are encouraged to build stock. Delivering products at the party strengthens your relationship with the clients, reduces backorders, and many times increases sales.
  • Any LOVEWINX™ Consultant that receives a Non-Delivery of Product report will be contacted. All Non-Delivery reports will be handled on an individual basis. The Consultant may be warned, suspended, or terminated if necessary. Please know that the LOVEWINX™ Corporate Office will cooperate fully with authorities if charges are filed against a Consultant for Non-Delivery of Product.

Confidential Information

Downline information, group lists, and sales reports are provided to each Consultant in the strictest of confidence. This confidential proprietary information is considered a business trade secret owned by LOVEWINX™. This information is made available to Active Consultants for the purpose of supporting and developing their LOVEWINX™ business. Consultants should use their Coachees information to motivate, manage, and train them. Every LOVEWINX™ Consultant who is provided trade secret information must please treat it as such by maintaining its confidentiality. Please do not use or disclose to any person, partnership, corporation, association, or other entity, any information considered a proprietary trade secret.

Legal Disclosure Statement

We appreciate all the people that you personally introduce to LOVEWINX™ as clients and customers. And we respect that you brought those relationships to our community. We expect that you will respect the same for all members of our community. LOVEWINX™ reserves all rights to enforce this expectation by initiating and/or supporting any and all legal actions against you from now until forever, whether initiated by LOVEWINX™ or by others if you interfere with LOVEWINX™ business by, including but not limited to:
  • Disrespecting and/or interfering with the relationships that other people brought to our community
  • Committing slander or libel against LOVEWINX™ or members of our community

Independent Contractor

A LOVEWINX™ Consultant is considered an Independent Contractor and not an employee of LOVEWINX™ and therefore the Corporate Office does not issue a W-2 form. You are self-employed and an independent business person who conducts business under an agreement with LOVEWINX™. LOVEWINX™ is required by Federal Law to report to the IRS and send you a 1099 form when you (a) purchase in excess of $5000 at wholesale prices (retail minus your buying discount) and/or (b) receive trips, gifts, awards, or monies with a value total in excess of $600 during the year. 1099 Forms will be mailed to you no later than January 31st each year. You must comply with all State, Local, and Federal laws applicable to your business. You are solely responsible for your own activities, in addition to all liabilities, obligations, and expenses which you incur. You must obtain all necessary licenses, permits, and other governmental approvals applicable to your business including qualifications to transact business in States other than your domicile. You must complete a Form W-9 and return it to LOVEWINX™ via email or mail ASAP to ensure timely delivery of commissions earned. Download form W-9 You may terminate your business relationship with LOVEWINX™ at any given time by providing a written notice to LOVEWINX™. LOVEWINX™ may terminate the business relationship with you at any time by providing written notice. For Canadian Consultants, a T4A will be issued by February 28th for earnings over $500.00. Active Consultant: A Consultant is Active when the Consultant Application and Agreement is completed and a minimum GP of $100 US / $133 CAD is achieved. Inactive Status: A Consultant’s status is updated to Inactive when they no longer maintain a Coach(es) and do not reach the minimum monthly GP of $100 US / $133 CAD. Reactivation: To Reactivate from an Inactive status, a Consultant must matchmake with a minimum of (1) Coach.

Change of Coach Request

To change your Coach(s), email CS@lovewinx.com to identify your new Coach(s) and include both your new and current Coach(s) in the email. Your requested new Coach(s) must email CS@lovewinx.com that they accept you as a Coachee and include the new Coachee and current Coach(s) in the email. Any requests made after the last payment of commissions will be processed after the 1st day of the next commission period.

Ordering & Shipping Guidelines

All orders must be paid in full prior to fulfillment. If more than one order is placed on the same business day, each order will be processed individually and separate shipping charges will apply. Once an order has been submitted, the corporate staff cannot edit the order or the shipping method. Please review your orders very carefully before submitting. Orders submitted on weekends and holidays will be received the next business day.

Out of Stock Items

When out of stock inventory becomes available, items will be shipped to you as soon as possible. When possible, backordered items will ship with the Consultant’s next order submitted. Should a backordered item be discontinued, the Consultant will be issued a credit to be used on a future purchase for the actual amount paid. Any backordered items will be forfeited if a consultant is terminated or resigns. If an out of stock item is shipped to you and returned to Corporate for any reason, you will be responsible for pre-paying the shipping fee to have the item re-shipped. When possible, returned orders will re-ship with the Consultant’s next order submitted.

Shipping

LOVEWINX™ cannot guarantee the delivery date of any shipment. LOVEWINX™ cannot ship to a P.O. Box for a shipping address, only to physical addresses. Federal regulations require aerosol items and certain liquids (i.e., products containing alcohol) to be shipped via ground shipping only. If a shipment is refused or returned to LOVEWINX™ for any reason: Shipping and Handling charges and a 20% Restocking Fee will be applied to the Consultant’s account. A check or credit will not be issued. If an order is returned, the order will be canceled. The products will need to be reordered. Once the order is canceled, it may affect the Consultant’s monthly Retail Sales. LOVEWINX™ makes every effort to pack orders in such a way to prevent product damage during shipment. If you receive a shipment that is damaged, lost, or stolen: Shipments become the responsibility of the carrier upon pickup from the LOVEWINX™ Corporate Office. If a Consultant receives a damaged package, we ask that they contact the LOVEWINX™ Corporate Office immediately upon receipt. Consultants should keep all products and packaging until resolution is achieved. If possible, pictures of the damaged box and/or contents should be taken. LOVEWINX™ will file a claim with the carrier and work with the Consultant to achieve resolution. If a Consultant receives their order and an item is missing, they must report it to CS@lovewinx.com no later than 5 business days from the delivery date. Please provide Order # and missing product name. Please note that some carriers will not leave a package unattended if there is no signature required (NSR); this decision is determined solely by the carrier and/or driver. Should an unattended package go missing, a claim may be initiated. If the package is not located, the carrier may reserve the right to flag the address and no future packages will be left at that address. For all future shipments in which guaranteed delivery is desired, a signature will be required and someone 18 or older may need to sign for delivery or the order may be picked up at the location designated by the carrier.

Return Guidelines (Return Materials Authorization)

LOVEWINX™ accepts merchandise returns for DAMAGED or DEFECTIVE products due to the nature of our products. A Return Materials Authorization (RMA) form must be completed and emailed to CS@lovewinx.com for approval. Due to health regulations, all returned items must be in original packaging, including batteries and/or accessories (if provided). Defective merchandise may be exchanged for duplicate items only. Any discontinued item cannot be returned. If a discontinued item is returned, it will be discarded and no credit will be issued. Any item obviously used for demonstration purposes will not be accepted for return and will be discarded. Replacement items will usually ship with the next Consultant order submitted. Any return that is tested and found to be in working condition will be returned at customer's expense. Otherwise, item will be discarded.

Sales Tax

When you place an order with the LOVEWINX™ Corporate Office, you are required to pay Sales Tax per the requirements of the State/County in which the product will be delivered. The amount of Sales Tax will be added to your order.

Personal Website, 3rd Party Websites & Email

LOVEWINX™ Consultants agree to cooperate fully so that internet searches list the exact location of their personal website. The use of the corporate office name, www.LOVEWINX.com, is strictly prohibited. Anyone in violation will be issued a warning and further action taken if necessary. Consultants are asked to use “LOVEWINX™ by (insert your name)” when advertising and promoting their business. Please contact Customer Service for approval to use any other term. Please do not represent yourself as an employee of LOVEWINX™. Anyone in violation will be issued a warning and further action taken if necessary. LOVEWINX™ may not be held liable for any downtime on your Personal Website due to server issues, maintenance, or any other reason. It is the responsibility of each LOVEWINX™ Consultant to make sure their LOVEWINX™ Personal Website fully complies with all Federal and State rules and regulations that apply. LOVEWINX™ Personal Websites cannot present false or misleading information about LOVEWINX™, the LOVEWINX™ opportunity, its products, parties, or your relationship with LOVEWINX™. Consultants will be held responsible for any statements or other content posted on their LOVEWINX™ Personal Website, including liability or harm caused by such statements or materials. Please carefully choose the information you post on your Personal Website. Please use your Personal Website to promote your LOVEWINX™ business only. Please do not include the following items: any photographs containing nudity or subject matter that is obscene, lewd, violent, harassing, sexually explicit, or otherwise objectionable subject matter. Please do not publish, post, or distribute any material on your LOVEWINX™ Website that is defamatory, libelous, offensive, harassing, threatening, obscene, or anything that inhibits others from enjoying the LOVEWINX™ Corporate Website or any Consultant’s LOVEWINX™ Personal Website. If promoting your LOVEWINX™ business on another website, please ensure the site does not include or link to sites that include the following items: any photographs or videos containing nudity or subject matter that is obscene, lewd, violent, harassing, sexually explicit, or otherwise objectionable. Violations may result in a warning or termination.

Social Media

LOVEWINX™ consultants are permitted and encouraged to have social networking accounts such as Facebook, Instagram, Twitter, YouTube, Tik Tok, etc. Please make sure that photographs, messages, profiles, videos, etc. posted on any site with mention of LOVEWINX™ be tasteful and not include any subject matter that contains nudity, lewd, obscene, harassing, sexually explicit, or otherwise questionable subject matter. Anyone in violation will be issued a warning and further action taken if necessary. Do not create/post false claims or inaccurate product and/or company information. Any posts generated with false information will result in a warning and further action taken if necessary.

Contest Travel Guidelines

  • Trips are non-transferable, and LOVEWINX™ is not responsible for transportation delays.
  • Trip departure date, destination, and itinerary are subject to availability. LOVEWINX™ reserves the right to adjust the original arrangements when necessary.
  • The following expenses are not covered and are not the responsibility of LOVEWINX™, unless otherwise specified:
    • Medical Expenses
    • Parking & Baggage Fees
    • Child Care
    • Incidentals/Telephone/Internet Charges
    • Transportation & Mileage (including airfare, unless otherwise specified)
  • Trip winners may change the original trip itinerary at their own expense. LOVEWINX™ is not responsible for any costs associated with the change(s). Should changes in trip plans affect LOVEWINX™ contractual agreement with a travel firm, changes are not allowed.
  • LOVEWINX™ will not reimburse Consultants or issue alternate prizes should the trip winner not be able to attend the trip for any reason.
  • When a trip destination requires a valid passport for travelers, trip winners are responsible for obtaining a valid passport before trip departure.
  • All trip companions must be at least 18 years old. Any exception to this policy must be approved by the Corporate Office.
